JMI Flooring's sale to Customer:

Is limited to and expressly made conditional on customer’s assent to the terms and conditions of sale contained herein, which supersede and reject all prior agreements, representations, discussions or negotiations, whether written or oral, with respect hereto and any conflicting terms and conditions contained in any purchase order or other writing by customer. By placing any order to JMI Flooring, customer hereby agrees to the following terms and conditions. Any additional terms or conditions set forth in customer’s purchase order or invoice are not accepted by JMI Flooring and are not binding or applicable to any transactions between JMI Flooring and customer.


Conditions:
While our goal is a 100% error-free Site, we do not guarantee that any content is accurate or complete, including price information and product specifications. If we discover price errors, they will be corrected on our systems, and the corrected price will apply to your order. JMI Flooring reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions (including after an order has been submitted and accepted).

You agree that JMI Flooring may at any time and without notice change the terms, conditions and notices under which this Site is offered.

Price:
All prices are subject to change or withdrawal without notice and all shipments will be at prices in effect on the date of shipment. Unless otherwise specified or required by law.

Prices displayed on this Site are quoted in U.S. dollars and are valid and effective only within the United States, and such prices do not include shipping and handling or sales taxes, if applicable, which will be added to your total invoice price. You are responsible for the payment of any shipping and handling charges and state and local sales or use taxes that may apply to your order.

Set-Off:
JMI Flooring shall have the right, at its sole discretion, to set-off against any amounts, and withhold from any payment which it may owe to customer, pursuant to any invoice, purchase order, agreement, sale, or transaction subject to these Terms and Conditions of Sale for any claims, amounts, or other liabilities it may have arising pursuant to any invoice, purchase order, agreement, sale, or transaction to which these Terms and Conditions of Sale apply.


Rejection and Revocation:
Products shall be deemed to be accepted and customer’s right to reject or cancel such products because of defect shall expire:

When twenty, 20 days have elapsed after customer knows of such defects

In the case of non-finished goods, when the products have been placed into any converting process.

If customer retains the products in its possession for more than fourty 40 days after delivery to customer without rejecting them, this shall constitute irrevocable acceptance of the products by customer, but shall not effect the warranty set forth by manufacture. If customer rejects or attempts to revoke his acceptance of any products delivered pursuant to this agreement, customer must notify JMI Flooring in writing fully specifying all defects and noncomformities. The failure to specify such defect or nonconformity shall constitute a waiver of that defect or nonconformity. No product shall be returned without JMI Flooring’s consent.


Products:
While we will use our best efforts to fulfill all orders, JMI Flooring cannot guarantee the availability of any particular product displayed on this Site. JMI Flooring reserves the right to discontinue the sale of any product listed on this Site at any time without notice.
